Artist Terms of Service

For my protection, and yours!

By purchasing any art or design from me, you automatically agree to these terms. Repeatedly breaking my TOS, or committing a major violation will lead to you being blacklisted, meaning I will not allow you to participate in any of my future sales. I reserve the right to modify these terms at any time.

BEFORE YOU COMMISSION:

My style (incl. lines, colouring, etc) may vary from the examples

Prices are in USD

By commissioning me, you are purchasing my artistic labor only.
☆ I retain all copyrights over my work, which include but are not limited to the right to distribute, reproduce or use the image as a sample for sales/self-promotion, unless otherwise agreed upon.
☆ I cannot claim the IP (intellectual property) or reuse/resell the image for personal and commercial projects.

Posting on Social Media:

You may re-upload the work done for them to any site, as long as it is properly credited and linked back to my site/s.
☆ Once a commission is completed, you may use it only for personal use including but not limited to: icons, signatures, layouts, wallpapers, themes, and personal site display. Above credit rules still apply.
☆ The commissioner/respective owner retains the rights to their IP (the character).
☆ You may not claim the work (art, design, etc.) to be your own.

After a certain period of time upon completion of a Commission the artist reserves the right to post the art work.

Please let the artist know prior if you wish to keep the Commission a secret for a certain period of time. However, this work can't be under lock and key. The client will be given a month before the art is posted, unless discussed prior and both parties agree.

Client's Right of Refusal: It is the intent of this contract that the Artist creates artwork for the Client that the Client will purchase the work. However, if, after the work is completed, the Client does not wish to purchase the work, the Client may refuse the created artwork. In that case, the Artist will retain the refused artwork The Artist is free of any claims and interests of the Client and the Client will not owe any additional fees to the Artist. Artist will keep the 50% deposit and retain ownership of the work. Should the Client be found using said artwork, a DMCA will be claimed.
Artist Right of Refusal: The Artist has the right to refuse and halt any commission that begins to cause the artist to feel unsafe and uncomfortable. In this case, a partial refund can be issued, depending on the stage of the commission.
Copyright: Artist reserves the common-law copyright to all works commissioned by Client that are created by the Artist, including all reproduction rights and the right to claim statutory copyright. The Client may reproduce no work without the prior written approval of Artist. This includes but not limited to: Buttons, T-shirts, and any apparel, Merchandise and sell able goods the client wishes to create. Client must state this is their intent from the beginning of the commission. This gives the artist time to add a severing fee.
Payment Terms: A nonrefundable deposit of one-half (50%) of the selling price is required before work commences. However if the client shows discomfort in paying the start up fee the artist may offer a very rough sketch in the form of a low-resolution image file (with watermark) before the first payment. If a rough sketch is sent the 50% non- refundable selling price will need to be paid before the artist commences work on the commissioned piece.

ADDITIONAL COSTS

Commercial Use
- Please let me know if you wish to use my art for Merchandise
- Additional Fee's will be included in the commission price to hand the rights over to you for use
Extra characters
- add 50% for each character (e.g. 1 character=$45, 2 characters= $67, 3 character's= $90
Character complexity
- character: intricate outfits
- ref sheet items: close ups, details, items, props
Rush Fee
- Rushing a piece can be done under the right circumstances. But this will cost an additional fee. Expect at least 20% of the commission price.

What to expect from ItsAshree:

Rough Draft, Flat Color and Render Check up before a final send off.
Files will be sent via Drive as: PNG, JPEG, and transparent PNG , unless requested otherwise.
Files will be kept in the drive for a month before deleted.
Touch ups and Revisions after the payment can be made, at the artist's discretion. Major revisions will require 30% of overall commission.
Estimate turnaround time is 1 week to 4 months depending on the nature of the commission. I balance a full time job, working on a comic, and life outside art. Therefore my schedule is subjective, please let me know if you cannot wait this period.

What do I need from you:

Agree to the Conditions, stated above.
You may choose to pay in 3 different ways.

Full payment upfront before starting- Partial Refund can only be issued at the Rough Draft stage. After that there can be no refunds.
50% of payment upon starting, then 50% before final file send off- Partial refund can only be issued at the Rough draft stage. No Refunds afterwards.
50% at rough stage, and 50% before final file send off- No refunds can be issued here.

Payment can be done through Paypal, Ko-fi or E-transfer
